Commission vote on the Cardinal's Nest resolution

Commission 5A voted 9 to 2 against the following resolution concerning the Cardinal's Nest Show Cause Hearing:

Resolution concerning the Cardinal’s Nest Show Cause Hearing, 3/2/09

WHEREAS, the Office of the Attorney General has brought charges against the Cardinal's Nest alleging a variety of violations, including: (1) amplified sound and music penetrating into residential areas and even individual homes; (2) serving underage and inebriated patrons; (3) failing to honor the voluntary agreement; WHEREAS, the ABC Board has scheduled a show cause hearing on the charges; WHEREAS, the ABC Board has referred other charges which the Office of the Attorney General may bring in the future; RESOLVED, due to the breadth and variety of the charges the Office of the Attorney General has brought, if the ABC Board sustains the majority of them, ANC 5A requests the ABC Board revoke Cardinal's Nest's license.

The majority of commissioners expressed the view that the commission had no standing in the matter, since the negotiated agreement was between the Cardinal's Nest and the community. Commissioners Blair and Feeley disagreed. - John Feeley
