Joint single member district meeting

Commissioner McCoy (5A05) and Commissioner Feeley (5A06) are inviting all resdidents of their single member districts to attend their joint February meeting at Turkey Thicket Recreation Center on Monday, 2/9/09, from 6:30 PM to 8:00 PM. The agenda will include an update on liquor license issues, zoning variance matters, crime issues and concerns about the 12th Street Improvement project, including proposed median strips. Pepco and DDOT arborists and our PSA have been invited to attend and share information at this meeting. The meeting will also offer an opportunity for residents to raise specific concerns impacting the districts. Tonight at the 5A Commission meeting, I proposed the following resolution to the Committee of the Whole: Proposed Resolution concerning ABRA and the Cardinal’s Nest:

Whereas the Alcoholic Beverage Regulation Administration has charged Brookland Restaurant Inc. t/a the Cardinal’s Nest with five violations of the alcoholic beverage regulation code, including serving alcohol to persons under the legal age, selling liquor not for consumption within the said establishment, and permitting the sale of side drinks on two separate dates, 3/28/08 and 8/28/08, and

Whereas the Brookland Restaurant Inc. t/a the Cardinal’s Nest has broken provisions of their voluntary agreement with residential neighbors in nine instances as observed by ABRA investigators on three different dates, 3/28/08, 5/17/08, on 6/22/08, and

Whereas the residents of 5A06 voted 18 to one in support of revocation of the Cardinal’s Nests ‘s license at a single member district meeting on 1/12/08,We, the Advisory Neighborhood Commission for 5A, support the revocation of the liquor license of said Brookland Restaurant Inc. t/a the Cardinal’s Nest on January 28, 2008.

This resolution was tabled and will be considered at the Committee of the Whole meeting to be held at the Committee of the Whole meeting on Thursday, February 5, at 6:30 at the Turkey Thicket Recreation Center. New Date Set for DDOT/Undergrounding Hearing

The Judge's chambers called at the end of the day yesterday, 1/27/09, to say that Thursday's court hearing concerning DDOT and use of funds for undergrounding has been rescheduled to WEDNESDAY, FEBRUARY 4TH at 10AM.

It is an important event: the Judge will be deciding whether to grant an injunction against DDOT for failing to obey the law passed by the DC Council and the Mayor requiring DDOT to bury the power lines on 12th Street with the remaining funds for the project. Live testimony will be presented by both sides at the hearing.

Everyone who is interested is encouraged to attend.

Postponement of the Show Cause Hearing

I have just been informed that the Show Cause Hearing concerning the Cardinal's Nest has been postponed until an undetermined date in March. It will not be held on Wednesday, February 4. When I receive this new date I will post in here and on the Brookland list serve. - John Feeley

Public Hearing on Brookland/CUA Small Area Plan

-Council Chairman Vincent C. Gray announces a public hearing by the Committee of the Whole on PR 18-46 (formerly PR 17-1229), the “Brookland/CUA Metro Station Small Area Plan Approval Resolution of 2009.” The hearing is scheduled for Tuesday, February 10, 2009, at 3:00 p.m., in the Council Chamber, Room 500 of the John A. Wilson Building, 1350 Pennsylvania Avenue NW. Individuals and representatives of organizations who wish to testify at the public hearing are asked to telephone Aretha Latta, Administrative Assistant to the Committee of the Whole, at 724-8196, or send e-mail to alatta@dccouncil.us, and furnish their names, addresses, telephone numbers and organizational affiliation, if any, by the close of business on Monday, February 9, 2009. They should also bring with them 20 copies of their written testimony or submit one copy of their written testimony by Monday, February 9, 2009. Persons presenting testimony may be limited to 3 minutes in order to permit each witness an opportunity to be heard.
